We are happy to work with projects that have finance in place from a lender such as a bank. If you’re unsure whether your project qualifies, please don’t hesitate to contact us for clarification.

3. What happens if my builder goes bankrupt?

If your builder goes bankrupt, your money is protected because it is held securely in our ring-fenced client escrow account. The funds will not be released to the builder, or the liquidator, until specific work stages are completed, and you are satisfied. PROTECT MY BUILD will then work with you to find a suitable replacement contractor to complete the project, using the remaining funds held in escrow. Our robust contract and expert guidance also help to minimise the risk of such an event occurring in the first place.

4. How does the escrow payment system work?

The escrow payment system is designed to be simple and secure. Before the project begins, you deposit the agreed-upon funds into our ring-fenced client account. We then manage the release of these funds to your builder in stages, based on the successful completion of pre-determined milestones outlined in your contract. We will not release funds until you are completely satisfied with the completed works or until an ADR scheme has resolved the dispute. This ensures that your builder is paid fairly and on time, while you retain control over your investment and only pay for work that meets your expectations.

5. What is ADR and how does it work?

ADR stands for Alternative Dispute Resolution. It’s a process that helps resolve disagreements between homeowners and builders outside of court, saving time and money. PROTECT MY BUILD offers access to a robust and timely dispute resolution scheme that includes mediation, adjudication, and arbitration through our partnership with CEDR, a leading ADR provider for construction disputes. If a dispute arises, we first encourage communication and may facilitate mediation. If that is not possible, we facilitate a referral to CEDR. They have expertise in construction-related disputes. There may be additional costs involved with ADR and mediation, which we will explain fully upfront.

We can put the contract in place between the homeowner and the builder.

8. What is the difference between adjudication and arbitration?

Adjudication is a fast-track dispute resolution process commonly used in the construction industry. An independent adjudicator reviews the case and makes a binding decision, usually within 28 days. This decision is temporarily binding, meaning it must be complied with immediately, but it can be challenged later in court or through arbitration. Arbitration is a more formal process where an independent arbitrator (or panel of arbitrators) makes a final and legally binding decision, similar to a court judgment. It is generally more time-consuming and expensive than adjudication but provides a definitive resolution.

9. What is mediation in construction?

Mediation is a voluntary and confidential process where a neutral third party (the mediator) helps the homeowner and builder negotiate a mutually acceptable resolution to their dispute. The mediator facilitates communication, identifies common ground, and helps the parties explore options for settlement. Mediation is often faster and less expensive than other forms of dispute resolution, and it allows the parties to maintain more control over the outcome.

10. Does PROTECT MY BUILD provide insurance?

PROTECT MY BUILD is not an insurance company. We provide a secure escrow service combined with expert contract management and access to dispute resolution. However, we strongly recommend that homeowners and builders have appropriate insurance coverage for their projects, including public liability insurance and potentially, specific project insurance.
